Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of X3WEB (Pty) Ltd's ("X3WEB", "we", "us", "our") website, services, platforms, and any related systems. It applies to all users, clients, visitors, and any person or entity accessing or using X3WEB's services.

By using our website or services, you agree to comply with this AUP. Violation of this policy may result in immediate suspension or termination of services, without refund, and may result in legal action.

1. Scope

This AUP applies to:

  • The X3WEB website at x3web.co.za
  • All services provided by X3WEB, including Meta Ads management, Google Ads management, website design and development, Growth System Retainers, hosting, and all other services
  • Any content, materials, or information submitted to X3WEB by clients or users
  • Any advertising campaigns, websites, or digital assets created or managed by X3WEB on behalf of clients
  • Any communication with X3WEB staff via email, phone, or any other channel

2. Prohibited Content

You must not use X3WEB's services to promote, advertise, host, or distribute any content that:

2.1 Illegal Content

  • Violates any applicable law or regulation in South Africa or any other jurisdiction
  • Promotes, facilitates, or engages in illegal activities
  • Infringes any intellectual property rights, including copyright, trademark, or patent rights
  • Violates any privacy rights or data protection laws
  • Constitutes defamation, libel, or slander

2.2 Harmful or Offensive Content

  • Is obscene, pornographic, or sexually explicit
  • Promotes violence, hatred, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Targets, exploits, or harms minors in any way
  • Is threatening, abusive, harassing, or intimidating toward any person or group

2.3 Deceptive or Misleading Content

  • Contains false, misleading, or deceptive claims about products, services, or the business
  • Impersonates any person, business, or organisation
  • Makes unsubstantiated health, financial, or performance claims
  • Violates consumer protection laws, including the Consumer Protection Act 68 of 2008

2.4 Platform-Prohibited Content

  • Violates Meta's Advertising Standards, Community Standards, or Terms of Service
  • Violates Google's Advertising Policies or Terms of Service
  • Violates the policies of any other platform or service used in connection with X3WEB's services
  • Promotes products or services that are prohibited by advertising platforms (including but not limited to: illegal drugs, weapons, counterfeit goods, tobacco, gambling where not permitted, and certain financial products)

3. Prohibited Activities

You must not use X3WEB's website or services to:

3.1 Technical Abuse

  • Attempt to gain unauthorised access to any part of X3WEB's website, systems, servers, or accounts
  • Probe, scan, or test the vulnerability of any system or network
  • Transmit any malware, viruses, worms, Trojan horses, ransomware, spyware, adware, or any other harmful code
  • Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Use automated tools (bots, scrapers, crawlers) to access or interact with the website without written permission
  • Harvest or collect email addresses, phone numbers, or other personal information from the website without consent
  • Attempt to bypass or circumvent any security measures, access controls, or authentication systems

3.2 Fraud and Misrepresentation

  • Submit false, fraudulent, or misleading information through any form or communication
  • Misrepresent your identity, business, or authority to act on behalf of a business
  • Engage in click fraud, ad fraud, or any activity designed to artificially inflate metrics
  • Initiate fraudulent chargebacks or payment disputes

3.3 Spam and Unsolicited Communications

  • Send unsolicited bulk emails (spam) or any other form of unsolicited communications
  • Use X3WEB's services to facilitate spam campaigns or mass unsolicited messaging
  • Violate the Electronic Communications and Transactions Act 25 of 2002 or any other applicable anti-spam legislation

3.4 Interference with Services

  • Interfere with or disrupt the integrity or performance of X3WEB's website or services
  • Interfere with any other user's access to or use of X3WEB's services
  • Attempt to reverse engineer, decompile, or disassemble any part of X3WEB's website or software

4. Client Content Responsibilities

When X3WEB manages advertising campaigns or creates digital assets on behalf of a client, the client is responsible for:

  • Ensuring that all products, services, and business practices advertised comply with applicable laws and regulations
  • Ensuring that all content, claims, images, and materials provided to X3WEB are accurate, truthful, and do not infringe any third-party rights
  • Obtaining all necessary licences, permits, and regulatory approvals for their business and the products/services being advertised
  • Complying with all applicable advertising standards, including those set by the Advertising Regulatory Board (ARB) of South Africa
  • Ensuring that any testimonials, reviews, or endorsements used in advertising are genuine and comply with applicable guidelines

X3WEB reserves the right to refuse to create or publish any content that, in X3WEB's reasonable opinion, violates this AUP, applicable laws, or platform policies — even if the client requests it.

5. Conduct Toward X3WEB Staff

All clients, users, and visitors must treat X3WEB staff with respect and professionalism. The following conduct is strictly prohibited:

  • Abusive, threatening, harassing, or intimidating communications toward any X3WEB staff member
  • Use of offensive, discriminatory, or derogatory language
  • Persistent unreasonable demands or behaviour that disrupts X3WEB's operations
  • Any conduct that creates a hostile or unsafe environment for X3WEB staff

X3WEB reserves the right to immediately terminate services and take legal action in response to abusive conduct, without refund.

6. Restricted Industries

X3WEB reserves the right to decline to provide services to businesses operating in certain industries, including but not limited to:

  • Businesses selling or promoting illegal products or services
  • Businesses that violate advertising platform policies (Meta, Google)
  • Businesses engaged in predatory lending, pyramid schemes, or multi-level marketing
  • Businesses promoting counterfeit goods or intellectual property infringement
  • Businesses involved in activities that X3WEB reasonably believes to be harmful, unethical, or reputationally damaging

X3WEB makes this determination at its sole discretion and is not required to provide a reason for declining to provide services.

7. Consequences of Violation

If X3WEB determines, in its sole discretion, that you have violated this AUP, X3WEB may take any or all of the following actions:

  • Issue a formal warning
  • Immediately suspend or terminate your access to X3WEB's services, without notice and without refund
  • Remove or refuse to publish any content that violates this AUP
  • Report the violation to relevant authorities, advertising platforms, or regulatory bodies
  • Take legal action to recover damages, costs, or losses caused by the violation
  • Report illegal activity to law enforcement authorities

X3WEB is not liable for any losses you suffer as a result of actions taken in response to a violation of this AUP.

8. Reporting Violations

If you become aware of any violation of this AUP, or if you have concerns about content or conduct on X3WEB's website or services, please report it to us immediately:

9. Amendments

X3WEB may update this Acceptable Use Policy at any time by posting the revised version on this page and updating the "Last updated" date. Continued use of X3WEB's services after any changes are posted constitutes acceptance of the updated policy. We encourage you to review this policy periodically.

10. Governing Law

This Acceptable Use Policy is governed by the laws of the Republic of South Africa. Any disputes arising from or related to this policy shall be subject to the exclusive jurisdiction of the South African courts.
